A Kenyan parliamentary team has thrown out a proposal to have a law prescribing death by public stoning to anybody found participating in homosexual acts. The Justic and Legal Affairs Committee argued that the Constitution not only establishes that the family is the natural and fundamental unit of society, but is forthright that Article 45 provides that every adult has the right to marry a person of the opposite sex. “These provisions adequately protect the family values that apply in our democracy,” it concluded.

Indeed, over the past 2 decades, researchers have turned up considerable evidence that homosexuality isn't a lifestyle choice, but is rooted in a person's biology and at least in part determined by genetics. Yet actual “gay genes” have been elusive. A new study of male twins, scheduled for presentation at the annual meeting of the American Society of Human Genetics (ASHG) in Baltimore, Maryland, today, could help explain that paradox. It finds that epigenetic effects, chemical modifications of the human genome that alter gene activity without changing the DNA sequence, may have a major influence on sexual orientation.

Zimbabwe President Robert Mugabe does not hide his disdain for gays and lesbians and is on record describing homosexuals as “worse that pigs and dogs” and homosexuality as a “white problem". Now, with less than three months before the opening of the International Conference on Aids and STIs in Africa (ICASA) conference set for December, Mugabe will once again be in the spotlight. Senior officials within government and in particular the National Aids Council (NAC) indicated that there seems to have been a climb-down within government following a realisation that “alienating these key populations would work against government efforts to reduce the prevalence of HIV and Aids”.

To hit the fast track running and live up to the visibility it has laudably given to human rights and gender, UNAIDS should commit strategy, budget and staff to integrating its human rights analysis into its models and targets. We can make law and policy a routine part of countries’ health planning, programming and reporting work. Just as it would be if we were talking about lung cancer.
