Formal approaches

In some cases, it may be necessary to take a more formal approach. However, before raising a formal grievance or going to an employment tribunal, the employee needs to think carefully about their goals, and the range of possible outcomes.

Bringing formal procedures may make work relationships even more tense or difficult. The processes can often be long, drawn-out and demoralising.

It’s important to be realistic about the chances of success at an employment tribunal. Often, cases are lost on what seems like a legal technicality rather than who is ‘in the right’.

Moreover, some employees may be tempted to resign and then make a claim for ‘constructive dismissal’. However, such cases are hard to win and this is a high-risk strategy. It should not be pursued without taking legal advice.
